Terms of Service
Last updated: October 18, 2026
These terms are the agreement between you and UpTest! (“we”) about using getuptest.com and the UpTest! app at app.getuptest.com (together, the “Service”). UpTest! is run by an independent AP® Statistics teacher. By creating an account or using the Service, you agree to these terms, our Privacy Policy, and our Refunds and Cancellation page. If you do not agree, please do not use the Service. Questions: support@getuptest.com.
What UpTest! is, and what it is not
UpTest! offers practice questions, a diagnostic, practice exams, flashcards, feedback on free-response answers, and class tools for teachers, to help students prepare for the AP® Statistics exam.
- AP® is a trademark registered by the College Board, which is not affiliated with, and does not endorse, this service. Our questions are written for UpTest! and are not actual exam questions.
- We cannot promise any score or result. Predicted scores, progress measures, and feedback are estimates meant to guide your practice.
- For official information about the exam, see the College Board’s AP Central.
Who can use UpTest!
- UpTest! is designed for high school students and teachers. It is not for children under 13.
- If you are under 18, please use UpTest! with the permission of a parent, guardian, or your school, and have a parent or guardian make or approve any purchase.
- If you are a teacher, you confirm that you are allowed to use UpTest! with your students under your school’s or district’s rules. You are responsible for the students you add to your classes and for who you share your class codes with.
Your account
Give us accurate information and keep your password private. Accounts are personal: do not share yours or let someone else use it. You are responsible for what happens under your account. Tell us at support@getuptest.com if you think someone else has used it.
Plans and payment
Free plan. You can use UpTest! for free, including the diagnostic, a daily allowance of practice questions (currently 12 a day), the formula Reference Sheet, and any work your teacher assigns. What the free plan includes may change. The current limits are shown in the app.
Paid plans. Paid plans unlock more, as described on the Premium page in the app (the Teacher plan page, for teachers). Prices are in US dollars and are shown before you pay:
| Plan | Price | How it works |
|---|---|---|
| Student, Monthly | $14.99 per month | Renews every month until you cancel. |
| Student, Full Course | $59.99, one payment | Does not renew. Access runs through May 31 of your AP® exam year. The last day of access is shown before you pay. |
| Teacher plan | $149 per year, plus $79 per year for each additional class | Covers your first class (up to 35 students). Renews every year until you cancel. |
Automatic renewal. Monthly and Teacher plans renew automatically at the end of each period, at the price then in effect, until you cancel. By buying one, you authorize us, through Stripe, to charge your payment method at each renewal. To avoid the next charge, cancel before the renewal date (see Refunds and Cancellation). The Full Course does not renew.
Teacher classes. The Teacher plan covers the number of classes you have paid for. Adding a class during the year is charged right away for the rest of the year. Removing a class gives a credit toward your next bill. Classes the plan does not cover keep the free class features.
Payments. Payments are processed by Stripe. We never see or store your card number. If a renewal payment fails, Stripe may try again, and your plan may end when the period you paid for runs out.
Price changes. We may change prices. A change to a subscription price takes effect at your next renewal, after we give you at least 30 days’ notice by email. You can cancel before then.
Refunds and cancellation
You can cancel a subscription at any time. How to cancel, and when we give refunds, are described on our Refunds and Cancellation page, which is part of these terms.
Acceptable use
Please do not:
- copy, share, post, sell, or scrape our questions, answers, explanations, guides, or other content, or use bots, scripts, or AI tools to collect or answer them;
- share a paid account, or work around limits, paywalls, or answer protections;
- try to break, probe, or overload the Service, or get into accounts or data that are not yours;
- upload anything unlawful or harmful, or anything that harasses others;
- use the Service in a way that breaks the law or a school’s rules, for example to cheat.
Our content and your license
UpTest! and everything in it (the questions, explanations, scoring guides, guides, flashcards, design, and software) belongs to us or our licensors and is protected by law. We give you a limited, personal, non-transferable license to use it for your own AP® Statistics study. Teachers may use it with their own classes through the Service. All other rights are reserved: you may not copy, republish, or sell it.
What you submit
You keep ownership of the answers and other things you submit. You give us permission to process them to run the Service: to score and show your work, to show it to the teacher of any class you join, and to improve our questions and explanations. As our Privacy Policy says, we do not use your answers to train AI models.
Free-response scoring and AI
Feedback on free-response answers may be produced by an AI system as well as by scoring guides. It can be wrong or incomplete. Treat it as practice feedback, not a grade or an official score. Your teacher’s judgment and the College Board’s official scoring guidelines come first. Please do not put personal information, such as your name or contact details, in your answers.
Classes and teachers
If you join a class with a class code, your teacher can see your activity in that class (see our Privacy Policy). Students never pay for a teacher’s plan.
Changes to the Service
We may add, change, or remove features, and we may update the questions. If we end the whole Service while you have a paid plan, we will refund the unused part of what you paid.
Suspending or closing an account
We may suspend or close an account that breaks these terms or puts the Service or other people at risk. You can close your account at any time by emailing support@getuptest.com. When an account closes, any paid plan on it ends, and refunds follow our Refunds and Cancellation page.
No warranty
We work hard to make UpTest! accurate and reliable, but we provide it “as is” and “as available.” To the fullest extent the law allows, we do not promise that it will always work, that it will be free of errors, or that any question, explanation, or feedback is free of mistakes. If you find a mistake, please tell us at support@getuptest.com.
Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or exam results. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing. Nothing in these terms limits a right or a liability that the law does not allow to be limited.
Disagreements and governing law
If you have a problem, please email support@getuptest.com first and give us 30 days to try to fix it. These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules, and disagreements will be handled in the state or federal courts located in Georgia, except where the law where you live gives you the right to go elsewhere.
Changes to these terms
If we change these terms, we will post the new version here with a new date. If a change is important, we will also email people with a paid plan before it takes effect. If you keep using the Service after the new date, you accept the new terms.
The rest
These terms, the Privacy Policy, and the Refunds and Cancellation page are the whole agreement between us about the Service. If a part of them cannot be enforced, the rest still applies. If we do not enforce something right away, we have not given up the right to. If UpTest! is sold or reorganized, we may transfer our rights and duties to whoever takes it over. You may not transfer yours.
